Eric Kolar is Board Certified in Business Litigation by the Florida Bar. He is AV rated by Martindale-Hubbell, is licensed to practice law in Florida and Georgia, and has 20 years of experience litigating business and contract disputes.  Eric is one of only 15 attorneys Board Certified in Business Litigation in Jacksonville. Eric represents vehicle leasing companies involved with contract disputes, vehicle leasing issues and recovery of vehicles and money after default. He additionally represents individuals and businesses in business disputes including breach of contract, Deceptive and Unfair Trade Practices Act claims, Civil Theft and other Florida statutory claims.   Eric represents homeowners and contractors with construction claims and disputes.

Eric helps creditors recover property from individuals who file for bankruptcy. Eric has experience prosecuting and defending various bankruptcy disputes including Motions to Lift the Stay, Adversary Proceedings to determine discharge of debt pursuant to 11 USC §523 and 11 USC §727, Bankruptcy preference litigation and Bankruptcy sanctions litigation for violations of the automatic stay.

Eric was a title agent and has extensive experience with disputes and complex Florida laws involving real property. He assists clients with various complex real estate problems, including title disputes and Estate and Trust disputes.

Eric represents commercial tenants and landlords in shopping center, strip mall and other developments with their lease dispute issues. Eric has represented owners and tenants in disputes over hotels, restaurants, convenience stores, gas stations and retails stores. The disputes involve disputed options to purchase, evictions, environmental issues, utility and CAM calculation errors, tax disputes and bankruptcy and distress for rent issues.

Eric has broad experience with homeowner disputes with contractors and homeowners contesting liens and fighting contractors who failed to complete projects or who walked off the job.

He also represents contractors and homeowners in construction disputes and lien issues.

Eric has been successful fighting bank foreclosures, including winning fees and damages for homeowners who were forced to file suit to seek enforcement of loan modification agreements. He has been able to keep homeowners in their homes pending disputes over their mortgages.

Eric represents homeowners, condominium associations and homeowners associations in disputes. Eric is the former President of a local condominium association and has experience dealing with homeowners and Condominium and Homeowner Associations, and resolving their disputes.

Clients forming corporations or buying or selling businesses are also represented.

Eric works with people needing to probate wills and trusts or challenge wills and trusts. There are substantial legal issues involving wills and trusts. Florida’s complex estate, homestead and trust laws must be considered carefully when drafting or probating a will. Florida’s Homestead and Elective Share laws may result in distributions of property different than what was intended by the drafter.
